Biden’s Lawyer Rips Special Counsel for ‘Shabby’ Report, But Waffles When Asked if Transcripts Should Be Released to Refute it

President Joe Biden’s attorney took issue with a special counsel report he called “very misleading” in its portrayal of his client — but then waffled when asked if interview transcripts should be released to refute it.

Appearing on Face the Nation Sunday, Bob Bauer — personal attorney to President Biden — lashed out at Special Counsel Robert Hur at what he believes to be “misstatements of facts and totally inappropriate and pejorative comments that are unfounded.”

He engaged, he answered the questions, and the special counsel’s decision to cherry pick, in a very misleading way, some of the references that you’re discussing here, is an example of what I call a really shabby work product and completely out of bounds for a prosecutor.

“This is a report that went off the rails,” Bauer said of the report produced by Hur — in which he took repeated shots at the president’s memory. “It’s shabby work product.”

Bauer said he was present for the special counsel’s interviews with his client on Oct. 8 and 9, and strongly disputed the characterization of the president as “an elderly man with a poor memory.

“He engaged, he answered the questions, and the special counsel’s decision to cherry pick, in a very misleading way, some of the references that you’re discussing here, is an example of what I call a really shabby work product and completely out of bounds for a prosecutor,” Bauer said.

But then, CBS’ Margaret Brennan asked Bauer if he supports releasing the transcripts from the two-day interview. And the president’s attorney began to waffle:

Brennan: So what you’re talking about and letters you’ve released, make it sound like there are indeed transcripts that you have, of these conversations over the eighth and the ninth.

Bauer: Yes. I’m doing here on my recollections. But yes, there are transcripts and as you heard Ian Sams in the press briefing room say, you know, there are discussions underway because it’s a classified document about what could or whether will be or when released. I can’t add anything to that today.

Brennan: Do you favor releasing them?

Bauer: Well, it’s really a decision that has to take place within the government. It’s a classified —

Brennan: — You’re the President’s counsel though.

Bauer: I’m the President’s personal counsel.

Brennan: Right. Would you recommend —

Bauer: Yes.

Brennan: — That these be made public if they indeed backup your personal record?

Bauer: Again, there’s a process underway. I’m not a specialist in that process. And so I really have to defer to those who have to work through those issues.
