Senate Majority Leader Mitch McConnell (R-KY) was awful giddy Thursday night while discussion the future confirmation of President Donald Trump‘s next Supreme Court nominee.

Appearing on Fox News, McConnell was asked to react to Sen. Kirsten Gillibrand (D-NY) accused the Senate Majority Leader of “setting the rules” by not allowing “a Supreme Court justice during an election year.”

“She left out an important word. What I said in 2016 is that we shouldn’t fill a Supreme Court vacancy in the middle of a presidential election year,” McConnell said. “The last time I looked, there’s no presidential election this year. In fact, three current members of the U.S. Supreme Court were completed in election years, non-presidential election years and the president’s nominee to this Kennedy vacancy will be confirmed in a non-presidential election election year.”

McConnell also dismissed Sen. Kamala Harris (D-CA) when she said that Trump’s eventual nominee is “potentially looking at the destruction of the U.S. Constitution” and Sen. Minority Leader Chuck Schumer (D-NY) who said Democrats will “fight til the very end.”

“Look, the stakes are big and the Democrats- let me tell you what they want and the kind of people they’ve put on the courts. Activist judges. What do we say when we mean an activist judge. Someone who acts like they were elected to Congress,” McConnell told Shannon Bream. ” And if you want to make policy, you ought to run for office. So the kind of people the president’s been sending up to the circuit courts, the nomination of Neil Gosuch, these are people who don’t believe the judge of a judge is to act like you’re a member of Congress but rather to interpret the law which is what the founding fathers clearly had in mind for the Judicial Branch.”
