Alan Dershowitz Slams Decision to Suspend Rudy Giuliani’s Law License: ‘The Criteria is So Vague…There’d Be No Lawyers Left’
Alan Dershowitz told Newsmax on Saturday morning that he does not think the suspension of Rudy Giuliani’s law license will hold up because “it was done without due process.”
Giuliani’s law license was suspended Thursday for “demonstrably false and misleading statements to courts, lawmakers and the public at large.” The decision called out his work as a lawyer for former president Donald Trump and his campaign in attempting to overturn the results of the 2020 election.
Dershowitz, who served on Trump’s defense team during his first impeachment and has worked with Giuliani in an advisory capacity, complained Saturday that the former NYC mayor never “had an opportunity to prove either that what he said was true or that if it wasn’t true that he didn’t know it.”
Giuliani, however, was given the opportunity to prove what he had alleged in terms of widespread voter fraud during the Pennsylvania suit, but the case was unanimously thrown out by the U.S. Court of Appeals because Giuliani’s team failed to show evidence that supported their claims.
“Free, fair elections are the lifeblood of our democracy,” wrote Judge Stephanos Bibas for the court. “Charges of unfairness are serious. But calling an election unfair does not make it so. Charges require specific allegations and then proof. We have neither here.” The opinion also described in detail multiple claims that Giuliani had made, and how they were easily disproven.
Dershowitz criticized the New York State appellate court’s criteria for suspending Giuliani’s law license temporarily and argued that “the criteria under which he was essentially disbarred” is “so vague.”
“It says anybody who says anything to a third party that turns out not to be true, I mean my God, there’d be no lawyers left,” he said.
Dershowitz then said that plea bargains and negotiations “always involve puffing of your side” and exaggerations. He later claimed other lawyers have “committed much, much worse lies.”
“If they went after him for only making misstatements in court, that would be one thing,” Dershowitz said. “But for making misstatements to the media, the vast majority of the allegations in the decision have to do with what he said on Newsmax and Fox and various podcasts. If you start holding lawyers responsible for everything they’ve said, my god.”
“I can tell you myself, from my own experience, many, many lawyers who have committed much, much worse lies in the public domain and they don’t go after them,” he continued. “This is very selective disbarment.”
